Respondents PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the second Respondent and the fifth Respondents to provide adequate Police Protection to survey the land property in S.No.159/12 situated at Avarangkulam, Village,Pillaryar Group,Tiruchuli Taluk,Virudhunagar District and to fence the same, based on the representation sent by the petitioner on 22.08.2021. ORDER

This petition has been filed seeking to grant police protection for the purpose of measuring the property, on the basis of the representation made by the petitioner, dated 22.08.2021. 2.When the matter is taken up for hearing, the learned Government Advocate (criminal side) would submit that based upon the representation made by the petitioner, enquiry has been conducted in C.S.R. No.66 of 2021, but, so far the petitioner has not appeared before the enquiry officer.

3.Considering the limited request that has been made by this petitioner, there shall be a direction to the petitioner herein to take appropriate steps to measure the property by making proper petition to the fourth respondent and in the event of such steps been taken, the Surveyor attached to the Taluk office, Tiruchuli, may undertake the enquiry under Section 10 of the Tamil Nadu Survey and Boundaries Act, by summoning the petitioner and other private parties, who are interested in the issue and depending upon the enquiry, that has been made if any trouble is caused or apprehended, he is at liberty to file proper petition to the fifth respondent seeking police protection.

4. The above said exercise shall be undertaken within a period of one month from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
