ORDER

This petition has been filed seeking direction to the third respondent to provide police protection to the petitioner on the basis of the representation, dated 27.07.2021. 2.When the matter is taken up for hearing, the learned Government Advocate (Crl.side) would submit that based upon the representation made by the petitioner, enquiry was undertaken in C.No.N4/17922/1356/P/2021, and during the course of enquiry, counter party, namely, Selvam has also appeared and gave a statement that the property belonged to one Ashok Kumar, who is the fifth respondent herein and on his instruction, he tried to cut the 1/3

Karuvela Trees from the property. In the enquiry, he undertakes due to the dispute over the property, he will not make any attempt in future. So, on the basis of the undertaken given by him, the representation made by the petitioner has been closed by the third respondent, by directing the parties to resolve the dispute through proper civil Forum.

3.Even though, the learned counsel for the petitioner would submit that, based upon the order passed by the Executive Engineer, Public Works Department, dated 24.01.2003, permitted the petitioner to take water through the above said property and now, it is disputed which cannot be gone into the matter as I mentioned earlier, the petitioner shall work out his remedy through the appropriate civil proceedings.

4.Recording the statement made by the learned Government Advocate (criminal side), this Criminal Original Petition is disposed of with the above said observation and direction.
