PRAYER: Habeas Corpus Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to direct the respondents to produce the body and person of the detenue by name Raja, aged 35 years, before this Court and set him at liberty.

ORDER

(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) The petition is filed to direct the respondents to produce the body and person of the detenue by name Raja, aged 35 years, before this Court and set him at liberty.

2.The case of the petitioner is that her husband Raja is a Carpenter and that on 04.05.2025, the fifth respondent had approached her husband and offered him work at Bangalore and thereby her husband had gone along with the fifth respondent to Bangalore and that the fifth respondent alone returned to his native place on 08.05.2025. When the petitioner had enquired about the whereabouts of her husband, the fifth respondent informed the petitioner that her husband along with Mesthri Kumar had gone to work at Natrampalli and thereafter, her husband 2/6

also informed her that he will return back to the house on 10.05.2025. Whereas, his phone was switched off and the whereabouts of her husband was not known and thereby on 15.05.2025 the petitioner had given a complaint before the fourth respondent and a case in Crime No.142 of 2025 was registered under 'Man missing'. When the petitioner had inquired the fourth respondent, she was informed that her husband's mobile phone was lastly located near to "Annai Indira Complex" at Kovilpatti and that the fourth respondent had orally instructed the petitioner to approach the local police. When the petitioner had approached the local police, the second respondent herein, there was no positive response from them and thereby apprehending danger to her husband's life, the present Habeas Corpus Petition is filed.

3.Mr.B.Rajesh Saravanan, learned counsel for the petitioner submitted that the petitioner's husband was found missing from 10.05.2025. While the petitioner had earlier approached the Natrampalli Police, Tirupathur District, they have informed that her husband mobile phone was lastly located at Kovilpatti and thereby she had also approached the local police. Since no action was taken on the part of the respondent police, the present Habeas Corpus Petition is filed. 3/6

4.The learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that based on the complaint given by the petitioner, a case was registered by the fourth respondent in Crime No.142 of 2025 under 'Man Missing'. During the investigation, call records were called for and the last location where the phone was switched off at Hosur and not Kovilpatti as stated by the petitioner. The learned Additional Public Prosecutor further submitted that the fourth respondent, the Inspector of Police, Natrampalli Police, is continuing with the investigation.

5.Taking into consideration of the aforesaid submissions, the Habeas Corpus Petition stands closed with a direction to the fourth respondent to continue with the investigation in Crime No.142 of 2025 and the Deputy Superintendant of Police, Vaniyampadi Division, shall monitor the investigation.
