To modify the condition imposed on the Petitioner to appear before the Trial Court i.e. Learned Sessions Judge, Fast Track Mahila Court/Additional POCSO Court, Tuticorin instead of appear before the Tirupur South Police Station, daily in Crl.M.P.(MD)No.5406 of 2026 in Crl.A.(MD)No.112 of 2025 by the order dated 29.04.2026.

ORDER

This Criminal Miscellaneous Petition is filed to modify the condition imposed on the petitioner in Crl.M.P.(MD)No.5406 of 2026 in Crl.A.(MD)No.112 of 2025, dated 29.04.2026.

2. The learned Government Advocate appearing for the respondent opposed this petition, that, considering the nature of the offence, this Court has directed the petitioner to reside at Tiruppur. Hence, the present petition seeking modification of the said condition is liable to be dismissed.

3. The petitioner has been convicted for the offence under the provisions of POCSO Act. Considering the nature of the offence committed by the petitioner, this Court had granted suspension of sentence subject to, among other conditions, that he shall stay at Tiruppur and report before the Inspector of Police, Tiruppur South Police Station, daily at 10.30 a.m., in order to avoid any further conflict with the victim. Therefore, this Court is not inclined to entertain this petition.
