Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India Praying for issuance of writ of mandamus, directing the Respondents 1 to 3 herein to enquire into the complaint given by the petitioner based on her representation dated 05.10.2016 after issuing notice to all interested parties and initiate appropriate legal action.

ORDER

The writ petition has been filed for a direction, directing the respondents 1 to 3 herein to enquire into the complaint given by the petitioner based on her representation dated 05.10.2016 after issuing notice to all interested parties and initiate appropriate legal action.

2.Since no adverse order is going to be passed against the fourth respondent, notice in respect of the fourth respondent is dispensed with.

3.According to the petitioner, the fourth respondent is her husband and they are residing in door No.1/90A, in Avudayarkovil, Aranthangi Taluk, Pudukkottai District. Earlier, they have living together and out of this wedlock, they have two children. Subsequently, the fourth respondent deserted the petitioner and he

is living with another lady. There also, the fourth respondent is having a ration card. The fourth respondent is also not entitled to have another ration card. Hence, she made a representation to the respondents 1 to 3 on 05.10.2016 to cancel the 2nd ration card, granted in favour of the fourth respondent. Sofar, no action has been taken. Hence, the petitioner has filed the present writ petition.

4.Heard the submissions made on either side and perused the material documents carefully.

5.Since the application of the petitioner is pending from 05.10.2016, the third respondent/Taluk Supply Officer, Avudayarkovil Taluk, Pudukkottai District is directed to consider the petitioner's application and to conduct an enquiry, after issuing notice to the petitioner and the fourth respondent and pass suitable orders, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

6.Accordingly, this writ petition is disposed of. There shall be no order as to costs.
