ORDER
The petitioner, an employee of the Transport Corporation, has filed this writ petition, with a grievance that he has not been provided with 5th review benefit.
2. The learned Standing Counsel submits that the petitioner has been provided with 4th review benefit and he is eligible for 5th review benefit only on 01.08.2023. However, he has been promoted in the officer cadre as Driving Instructor on 08.05.2023 and he retired from 2/5
service on 30.06.2023. According to the learned Standing Counsel, the Officer Cadre Employee is not eligible for the review benefit. Therefore, the petitioner is not entitled for 5th review benefit.
3. At this juncture, the learned counsel for the petitioner submits that the petitioner is entitled for arrears of pay as per VII pay commission.
4. In reply, the learned Standing Counsel submits that in the representation dated 29.05.2023, the petitioner has confined his relief only for 5th review benefit.
5. Without any material, this Court is not inclined to grant any relief to the petitioner. However, liberty is granted to the petitioner to submit a fresh representation, seeking difference of pay, if any, as per VII pay commission.
6. In the event, if any such representation has been made by the petitioner, the same shall be considered on merits and disposed of within 3/5
a period of 12 weeks from thereon.
