JUDGMENT

(By G.R.SWAMINATHAN, J.) Heard both sides.

2.The State is on appeal questioning the order dated 23.02.2022 allowing W.P.(MD)No.21291 of 2014 filed by the first respondent. 3.The first respondent herein was working as Sub-Registrar, Registration Department, Natham during 2001 - 2004. He was issued with charge memo dated 03.08.2005 alleging that on account of his omissions and commission, the government was put to revenue loss to the tune of Rs.2,24,479/-. This loss amount was subsequently scaled down to Rs.1,67,769/-. This amount was recovered from the writ petitioner's terminal benefits. Challenging the said action of the Inspector General of Registration, the first respondent herein filed 2/4

W.P.(MD)No.21291 of 2014. In the counter affidavit filed in the writ proceeding, the appellants had admitted that the loss attributed to the writ petitioner was subsequently realized. Taking into account the subsequent development, the learned Single Judge allowed the writ petition. Interference with the said order is not warranted. The writ appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
