ORDER

The petitioner seeks for a Mandamus directing the second respondent to furnish five tender schedules to the petitioner by receiving its charges and Earned Money Deposit amount within the time limit fixed by this Court, so as to enable him to participate in the tender, which was notified as per the second respondent's proceedings in Na.Ka.No.B3/3662/2015 dated 19.01.2016 based on his representations dated 27.01.2016 and 28.01.2016.

2. By consent of both parties, the main Writ Petition itself is taken up for final disposal.

3. Mr.M.Rajarajan, learned Government Advocate takes notice for the first respondent and Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader takes notice for the second respondent.

4. The petitioner claims to be the Class - I registered contractor. The second respondent had issued a tender notification, dated 19.01.2016 and the last date for receiving the tender schedule form is 04.02.2016 (upto 03.00 p.m).

5. The grievance of the petitioner is that he could not get the tender schedule form, because of which, he could not participate in the tender. He has also made a representation to the second respondent on 27.01.2016 to furnish the tender schedule forms, so as to enable him to participate in the above tender. As the request has not been heeded to, the present Writ Petition is filed.

6. The learned counsel appearing for the second respondent submitted that five tender forms will be issued to the petitioner on payment of charges.

7. Recording the submission made by the learned counsel appearing for the respondents, this Writ Petition is disposed of directing the second respondent to give five tender schedule forms to the petitioner on 03rd February, 2016 before 12.00 noon.
