ORDER
(Order of the Court was made by N.KIRUBAKARAN,J) The petitioner has challenged the impugned notice issued under Section 6 of the Land Encroachment Act, by the fourth respondent, stating that the petitioner has encroached upon the 1/3
pathway and constructed a house and wash room.
2. Heard Mr.B.Jameel Arasu, learned Counsel appearing for the petitioner, Mr.K.MU.Muthu, learned Additional Government Pleader appearing for the respondents 1 and 2 and Mr.A.Muthukaruppan, learned Additional Government Pleader appearing for the respondents 3 and 4 and perused the materials placed on record.
3. The fourth respondent has got no jurisdiction to invoke the Land Encroachment Act and therefore, the impugned order is liable to tbe set aside and accordingly, the same is set aside. However, it is made clear that the fourth respondent is entitled to invoke the Panchayat Act and follow due process of law, if the petitioner has encroached upon the public property or pathway and proceed with the matter.
4. With the above observations, this Writ Petition is allowed. No costs. Consequently, the connected Miscellaneous Petition is closed.
