O R D E R
The present Writ Petition is filed for issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 07.10.2025 and consequently issue patta in the name of Arulmigu Sri Akkammal Temple in respect of the lands measuring an extent of 11 Acres and 77 Cents comprised in Survey Nos.38 and 42/5, situated at K.Paraipatti Village, Kundairuppu Village, Vembakkottai Taluk, Virudhunagar District.
2. The present Writ Petition is filed by one Pethiya Naicker, who claims that he is a committee member of the temple and that the said committee has been actively administering the said temple from the year 2008 onwards. The petitioner claims that the lands comprised in Survey Nos.38 and 42/5, situated at K.Paraipatti Village, Kundairuppu Village, Vembakkottai Taluk, Virudhunagar District, to an extent of 11 Acres and 77 Cents, belong to the temple. Even in the SLR and 'A' Register, the name of the temple is entered. According to the temple, there are several Page No. 2 of 5
encroachments. Hence, the petitioner, in order to protect the temple properties, is seeking issuance of patta in the name of the temple. The said representation was submitted as early as on 07.10.2025. Since the same is pending, the present Writ Petition is being filed.
3. Therefore, the third respondent, Tahsildar, is directed to consider the petitioner's representation dated 07.10.2025 and if all the records are in favour of the petitioner temple, the third respondent, Tahsildar, is directed to issue patta in the name of the deity of the temple. The said exercise shall be completed within a period of 12 weeks. In case there are any encroachments, the petitioner is directed to take appropriate action in accordance with law by following due process of law.
4. With this direction, this Writ Petition is disposed of. There shall be no order as to costs.
