PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents to grant permission and to give a police protection to conduct Bullock Cart Race scheduled on 28.07.2024 at about 04.00 a.m. upon petitioner's representation dated 18.07.2024. ************ [Order of the Court was made by R.SURESH KUMAR, J.] The prayer sought for herein is for a Writ of Mandamus, to consider the representation of the petitioner dated 18.07.2024, regarding the proposed conduction of Bullock Cart race on 28.07.2024, at the petitioner's place.

2.Heard Mr.KR.Bharathi Kannan, learned Counsel for the petitioner, Mr.P.Thilak Kumar, learned Government Pleader appearing for the respondents 1 & 2 and Mr.T.Senthil Kumar, learned Additional Public Prosecutor appearing for the respondents 3 & 4.

3.Learned Government Pleader would submit that first of all, the representation seems to have been given only on 18.07.2024 but they propose to conduct Bullock Cart race on 28.07.2024. Secondly, that they want to conduct the Bullock Cart race for 16 miles which is very long. Moreover, the reason for conducting the Bullock Cart race also to be gone into, as it is not a public or common reason like temple festival etc. Therefore that also has to be taken into account by the respondents. Anyhow, the learned Government Pleader would submit that the representation of the petitioner dated 18.07.2024 would be considered and decided on merits by the first respondent / District Collector. 4.Recording the said submissions made by the learned Government Pleader and having regard to the aforestated facts and circumstances, we are inclined to dispose of this writ petition by giving a direction to the first respondent to consider the representation of the petitioner dated 18.07.2024 and to pass necessary orders thereon on merits and in accordance with law at the earliest.
