Respondent Prayer : Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, to withdraw the proceeding in H.M.O.P.No. 332 of 2018 on the file of the Family Court, Trichy and transfer the same to the file of the Sub Court, Hosur, Krishnagiri District. ORDER

When the matter is taken up for hearing, the learned counsel on either side submitted that the matter has been amicably settled between the parties before the Mediation, and the parties have entered into a settlement Page No 1 of 4

agreement before the Mediation, and the present Transfer Civil Miscellaneous Petition may be disposed of accordingly by recording the same.

2. Mediation Report with settlement agreement has been received by this Court. As per the settlement agreement, both the parties have settled their dispute on the following terms :

"(a) That C.Banupriya (wife)/petitioner and P.Chandru (Husband)/Respondent came to an amicable settlement. (b) That the petitioner/wife agreed for 5 lakhs rupees for future maintenance of herself and her son Hiren (aged 6 years).

(c) That the respondent agreed to pay this amount by way of Demand Draft in the name of the Petitioner/Wife on or before 05.08.2024.

(d) That the petitioner agreed on 05.08.2024 to give back the 'Thali'(gold) on receipt of the Demand Draft to the amount of Rs.5 lakhs.

(e) That the Respondent/Husband filed an H.M.O.P.No. 332/2018 for divorce on the file of the family Court Trichy. The same would become infructuous in terms of the settlement between the parties before this Tamilnadu Mediation and Conciliation Centre, Madurai Bench.

(f) Today the respondent handed over the Demand Draft of Rs.5 lakhs in favour of petitioner/wife drawn in Indian Overseas Bank, K.Sathanur Branch in D.D.No. 148658960 dated 05.08.2024. The petitioner/wife handed over the Thali (gold) weight about 10 grams to the husband/respondent.

(g) That there are no more grievances pending between them."

3. In view thereof, this Transfer Civil Miscellaneous Petition is disposed of by recording the settlement agreement. The settlement agreement shall form a part of this order. No costs.
