For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.38 of 2022 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 353, 506(2), 379 of IPC and Section 21

(5) of the Mines and Minerals (Development and Regulations) Act, 1957, in Crime No.38 of 2022, seeks anticipatory bail.

2. The learned counsel for the petitioner would submit that the petitioner is ready to comply any stringent condition that may be imposed by the Court.

3. The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that the earlier anticipatory bail applications that were filed by the petitioner in Crl.O.P(MD).Nos.10858 of 2022, 16908 of 2022 and 754 of 2023, were dismissed by this Court, on the ground that the petitioner is a habitual offender. Without any change of circumstances, the present petition has been filed.

4. Considering the fact that there is no change of circumstances and the petitioner has not complied with the direction of this Court to surrender before the concerned Court and thereafter seeks bail, this Court is not inclined to grant anticipatory bail to the petitioners. Hence, this Criminal Original Petition is dismissed.
