Criminal Revision Case is filed under Sections 397 r/w 401 of the Criminal Procedure Code, to call for the records pertaining to the order passed by the Learned Principal District and Sessions Court, Karur in Crl.MP.No.2027 of 2023 dated 06.12.2023 and set aside the same and allow the above Criminal Revision Petition.
ORDER
This petition has been filed to modify the condition imposed in Crl.R.C(MD) No.27 of 2024 dated 15.02.2024 related to "conditions no.1.the petitioner shall prove her ownership of the vehicle by producing the R.C. book and other relevant records and ii) the R.C. Book shall be deposited in the Court and the Court shall issue a certificate in this regard" and to accept the photocopy of the R.C. Book.
2. The petitioner has filed an affidavit undertaking that he would submit the duplicate R.C book of the vehicle/Bolero pickup bearing Registration No.TN 47 BY 2877 before the learned Principal District and Sessions Judge, Karur after two months from the release of her vehicle.
3. However, considering the fact that the vehicle was seized in an offence under Section 302 of IPC, such a long period of two months cannot be granted for release of her vehicle. In view of the same, this Courts permits the petitioner to submit the duplicate R.C book before the Principal District and Sessions Judge, 2/4
Karur within a period of 20 days from the date of release of his vehicle / Bolero pickup bearing Registration No.TN 47 BY 2877. The petitioner is directed to make an application on the very next day of obtaining the interim custody of the vehicle before the Regional Transport Officer, Manmangalam. The Regional Transport Officer, Manmangalam is directed to issue the duplicate copy of the R.C book within a period of fifteen (15) days from the date of application from the petitioner and the petitioner is directed to submit the same before the learned Trial Court within five
(5) days from the date of receipt of duplicate R.C book.

Accordingly, this Criminal Miscellaneous Petition is allowed, modifying the condition nos.(i) and (ii), that the petitioner shall prove her ownership of the vehicle by producing the R.C book and other relevant records and the R.C book shall be deposited in the Court and the Court shall issue a certificate in this regard respectively.
