ORDER : The Court made the following order :- The petitioner / Accused No.1, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 448, 294 (b), 427, 341, 323, 324 and 307 of IPC, in Crime No.58 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 03.05.2023, the defacto complainant has conducted baby shower function to his wife in his house in the presence of their relatives. At that time, the petitioner along with other accused persons bursted crackers when they were on the way to temple. That crackers entered into the defacto complainant's house. The defacto complainant asked the accused persons not to burst crackers near his house, the petitioners along with other accused persons abused the defacto complainant in filthy language, assaulted and threatened him with dire consequences. The defacto complainant sustained injuries due to this incident. Hence the complaint.

3. The learned counsel for the petitioners submitted that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. Therefore, seek the relief of anticipatory bail.

4. The learned Additional Public Prosecutor would submit that the earlier applications for anticipatory bail has been dismissed by this Court, for the reason that five previous cases are pending against the petitioner. He would further submit that there is no change in circumstances.

5. Even on merits, I find absolutely no reason to differ from the earlier view. Reading of the First Information Report itself shows the brutality which was exhibited by the petitioners.
