2. The respondents have been served with private notice and proof of service has also been filed. Though the name of the respondents have been

printed in the cause list, there is no representation for them either in person or through their counsel and no counter affidavit has been filed.

3. Considering the reasons stated in the accompanying affidavit, we are inclined to condone the delay.

4. Accordingly, this civil miscellaneous petition is allowed and the delay of 101 days in filing the above writ appeal is condoned.
