ORDER
This petition has been filed to direct the second respondent not to harass the petitioner under the guise of enquiry.
2. Heard the learned counsel for the appearing for petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents. Considering the nature of the order going to be passed in this petition, notice to the third respondent is dispensed with.
3. According to the petitioner, there is a money dispute between the petitioner and the third respondent. Based on the complaint given by the third respondent, with regard to the above said dispute, the second respondent is harassing the petitioner. Hence, the present petition has been filed.
4. Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the official respondents, on instructions, would submit that there is a money dispute between the petitioner and the third respondent. The third respondent has given a complaint stating that he has borrowed some https://hcservices.ecourts.gov.in/hcservices/
money from the petitioner and after some time he repaid the entire amount. Now by using the blank cheque given by the third respondent at the time of borrowing money, the petitioner withdrew the amount from the third respondent account. Now the enquiry is pending. The petitioner without appearing for the enquiry, has made the present complaint.
5. Considering the fact that the enquiry in this case is pending, the petitioner is directed to appear before the second respondent police and cooperate with the enquiry. The second respondent is also directed to proceed with the enquiry, and complete the same as expeditiously as possible.
6. With the above direction, this Criminal Original Petition is disposed of.
