Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 and 2 to consider the petitioner's representation dated on 10.03.2025 and to conduct proper enquiry and to take appropriate action in respect of fraudulent act done by the third respondent.

ORDER

This writ petition has been filed for a Mandamus to direct the respondents 1 and 2 to consider the petitioner's representation dated 10.03.2025 and to conduct proper enquiry and to take appropriate action in respect of fraudulent act done by the third respondent.

2. This writ petition is disposed of at the time of admission after dispensing with notice on the third respondent as no adverse orders are proposed to be passed against him.

3. It appears that the third respondent has executed a settlement deed in favour of his son. It is the case of the petitioner that the settlement deed was executed by making a false statement that the third respondent alone was the legal heir of Late.Janaki Ammal. The petitioner has submitted a representation, dated 10.03.2025 for cancelling the legal heirship certificate issued for the said Janakiammal, who was the grandmother of both the petitioner and the third respondent as the legal heirship certificate has been secured without due notice to the petitioner. 2/4

4. Considering the same, there shall be a direction to the second respondent to consider the petitioner's representation, dated 10.03.2025 and dispose of the same after hearing all the legal heirs of the Late.Janaki Ammal and after obtaining necessary information with the help of the Village Administrative Office of the concerned Village, where the petitioner's grandmother died, within a period of 6 weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of with the above direction. There shall be no order as to costs.
