PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the III Additional District and Sessions Judge, PCR Cases, Madurai, to consider the bail application on the surrender of the petitioner/accused No.2 on the same day in connection with Cr.No.560/2025, on the file of the respondent police, on merits on the same day.

ORDER

The present petition has been filed by the second accused in crime No. 560 of 2025, on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of surrender.

2. Considering the averments in the petition, there shall be a direction to the III Additional District and Sessions Judge, PCR Cases, Madurai, to consider the bail application of the petitioner on the same day of surrender in crime No. 560 of 2025, after giving due opportunity to the defacto complainant.

3. The petitioner shall surrender before the concerned Court on or before 23.06.2026.

4. With the above said observations, this Criminal Original Petition stands allowed.
