O R D E R

The instant writ petition has been filed by a Conductor working in the respondent transport corporation seeking a mandamus directing the respondents to withdraw the charges framed as against him and the order of punishment imposed upon the petitioner on 31.08.2022.

2. The prayer sought for in this writ petition is not maintainable. The petitioner has to challenge the order of punishment before the appellate authority and he cannot seek for withdrawal of charges or cancellation of punishment order.

3. In view of the above said facts, this writ petition is disposed of, with a liberty to the petitioner to file an appeal before the first respondent within a period of four weeks from the date of receipt of a copy of this order. If any such appeal is filed by the petitioner, the first respondent shall entertain the same without any reference of period of limitation and the same may be disposed of within a period of twelve weeks from the date of receipt of appeal.

4.With the above said observations, this writ petition stands disposed of. No costs.
