PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st and 2nd respondents herein to take necessary action upon the petitioner's representation dated 15.03.2025 wherein seeking to cancel the legal heir certificate issued by the 4th respondent in his proceedings PA.MU.No.21317/2007/C1 dated 17.09.2007. ORDER

Mr.C.Satheesh, learned Government Advocate takes notice for the respondents 1 to 4.

2.The petitioner has filed this writ petition for a Mandamus to direct the respondents 1 and 2 herein to act on the petitioner's representation dated 15.03.2025, wherein the petitioner has sought for cancellation of the legal heirship certificate issued by the fourth respondent/the Tahsildar in favour of the respondents 5 and 6 herein along with few others on 17.09.2007. 2/5

3.It is submitted by the learned counsel for the petitioner that the aforesaid legal heirship certificate has been obtained stating that the petitioner's father, namely, Arunachalam, died on 20.04.1979, when indeed he died only on 04.11.2009.

4.It is submitted that the petitioner has also obtained a clarification under Right to Information Act as to the correctness of the death certificate issued in the name of the petitioner's late father, Arunachalam on 20.04.1979, wherein it has been informed that the death certificate and the consequential legal heirship certificate are false and fabricated. The petitioner has given a representation to the third respondent on 21.10.2024, which has not been evoked any response. 5.The learned Government Advocate for the respondents 1 to 4 would submit that the petitioner's request will be considered and disposed of on merits. 6.Recording the above submission, this Writ Petition stands disposed of, after dispensing with the notice on the private respondents 5 and 6, by directing the third respondent to pass appropriate orders on the petitioner's representation, 3/5

dated 21.10.2024 for cancellation of the legal heirship certificate dated 17.09.2007 after due notice to the others as well as whose names have been given in the aforesaid legal heirship certificate, dated 17.09.2007, apart from the respondents 5 and 6 herein, within a period of three months from the date of receipt of a copy of this order. No costs.
