Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to withdraw the charges were framed under Rule 16(8)/16(9) and (14) of and awarded punishment to stop payment for two years as well as with the other benefits by proceedings dated 06.08.2020 Onathu/D2/Me/2991 and 2992 by way of considering the petitioner's representation, dated 13.03.2024. ORDER

Heard Mr.S.Sivakumar, learned counsel appearing for the petitioner and Mr.K.Ramaiah, learned Standing Counsel appearing for the respondents.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The petitioner has filed this writ petition directing the respondents to withdraw the charges framed under Rule 16(8) /16(9) & 14 and consequential punishment imposed to stop payment for 2 years 2/5

and other benefits as per the order, dated 06.08.2020.

4. Despite the petitioner has got the appeal avenue, he has not make use of the same and straight-away filed this writ petition.

5. In fact, the final order itself has also been passed on 31.08.2022 and the petitioner is at liberty to challenge the same, in the manner known to law.

6. In view of the same, this writ petition is disposed of with liberty to the petitioner to challenge the impugned order by way of filing an appeal before the first respondent within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the first respondent shall dispose the same as expeditiously as possible. No costs.
