ORDER
The present writ petition is for a Writ of Certiorarified Mandamus, to call for the records on the file of the first respondent in proceedings No. P.Three-18/2012-Pension-Gr.K, dated 22.11.2022 and quash the same and consequently to direct the first respondent to correct the name of the petitioner's wife as K.Jayamala instead of K.Siyamala in the service record / PPO No. 239031107121.
2. Heard the learned Counsel for the petitioner and the learned Deputy Solicitor General for the first respondent and carefully perused the materials available on record.
3. The petitioner joined as Constable G/D, Chennai, 31-Battalion on 27.07.1989. The petitioner retired from service on Voluntary Retirement 2/6
Scheme on 01.11.2010 as Head Constable in Central Reserve Police Force with service No.890310035. He married one Jayamala, daughter of Jayaram as per Hindu Rights and Customs in his native place at Dindigul District. He has two children, namely K.Sivasankaran and K.Gowrisankaran. While in service, he furnished the name of his wife to be included in the service records / PPO No. 239031107121 for the purpose of getting family pension to his wife. However, the respondent Office entered his wife name as K.Siyamala instead of K.Jayamala in the service record due to wrong pronunciation and communication between the petitioner and the officers concerned. That mistake was not a wilful mistake and hence, that error has to be corrected and for the same, the petitioner made a representation on 03.11.
2022 to the first respondent, requesting to correct the name of his wife as K.Jayamala instead of K.Siyamala in the PPO Book and other records. The impugned order, dated 22.11.2022 came to be passed rejecting the petitioner's claim that it is not possible to change the name of his wife in the PPO Book. Challenging the same, this writ petition came to be filed.
4. The learned Deputy Solicitor General for the first respondent would submit that in case if the petitioner is able to produce the necessary documents, 3/6
which would prove that the said K.Jayamala is his wife along with necessary legal documents to prove his marriage and an affidavit to that effect, the respondents would consider to include his wife's name in the appropriate records.
5. Recording the above said observation, this writ petition stands disposed of.
