ORDER:- This Writ petition coming on for orders on this day and upon perusing the petition and affidavit filed in support thereof and upon perusing the earlier order of this Court dated 28/9/2021 and upon hearing the arguments of Thiru.R. Murugappan, Advocate for the Petitioner and of Thiru.D. Sadiq Raja, Additional Government Pleader for the respondents, this Court made the following order: "The co-ordinate bench of this Court vide judgment and order dated 28.09.2021 dismissed the present Writ Petition in the following terms: "10.Accordingly, this Writ Petition is dismissed with a cost of Rs.1,000/- payable to the District Legal Services Committee within a period of four weeks from the date of receipt of a copy of this order. 11.Post this matter for reporting compliance on 29.10.2021."

2. Today, the matter is listed under the caption "For Reporting Compliance." Mr.R.Murugappan, learned counsel for the Petitioner, submitted that this Court had dismissed the present writ petition by imposing a cost of Rs. 1000/- (Rupees One Thousand only) payable by the Petitioner to the District Legal Services Committee. As the Petitioner is unemployed and financially constrained, he was unable to arrange the amount as directed by the co-ordinate bench of this Court within the stipulated time. Due to his poverty, it took him more than four years to collect the required amount of Rs. 1000/- and to deposit the same before the District Legal Services Committee, Madurai. Now, he has managed to arrange the money and is 2/5

ready to deposit it before the District Legal Services Committee. However, the District Legal Services Committee is refusing to accept the amount on the ground that the cost imposed by the Co-ordinate Bench of this Court for the Petitioner to pay Rs.1000/- has exceeded the prescribed timeline. Therefore, he prays that this Court takes a sympathetic view of the Petitioner's situation and directs the District Legal Services Committee to accept the amount as imposed by the Co-ordinate Bench of this Court in its judgment and order dated 28.09.2021 in the present writ petition.

Mr.D.Sadiq Raja, learned Additional Government Pleader for the Respondents, submitted that since the Petitioner is approaching this Court more than 4 years after the judgment and order passed by the co-ordinate bench of this Court, and considering his financial condition and unemployment, this Court may take a sympathetic view and direct the Petitioner to deposit the amount before the District Legal Services Committee, Madurai, within a timeline fixed by this Court.

4. Considering the submissions made by the learned counsel for the Petitioner and the learned Additional Government Pleader for the Respondents, this Court, adopting a sympathetic view, directs the Petitioner to deposit the sum of Rs. 1000/- (Rupees One Thousand only), the cost imposed by the Co-ordinate Bench of this Court in its order dated 28.09.2021 in the present writ petition, within a period of 3/5

one week from today before the District Legal Services Committee, Madurai.

5. Accordingly, the prayer of the Petitioner is accepted, and no further order is required to be passed in the present writ petition. The file shall be consigned to the records."
