ORDER

Mr.K.R.Badurus Zaman, learned Government Advocate takes notice for the respondents 1 and 2.

2.This writ petition has been filed for a Mandamus to direct the first respondent to conduct enquiry and issue legal heir certificate, based on the petitioner's representation dated 20.06.2024. 3.The petitioner claims to be a son of late.Rajan @ Rajagoundar, who died on 16.03.1995. It is the case of the petitioner that the petitioner's father had two wives, namely, Pappa and Sirumbayee and that the second marriage was contracted during the subsistence of the first marriage and that the petitioner's mother and the said Pappa are sisters.

4.It is further submitted by the petitioner that the respondents 3 and 4 are the children of the said Pappa through the first marriage and the petitioner and the fifth respondent are the children through the second wife, namely Sirumbayee. 5.It is the case of the petitioner that the petitioner as well as the respondents 3 to 5 are entitled for their names being included in the legal heirship certificate to be issued in the name of the petitioner's father. In this connection, the petitioner has given a representation dated 20.06.2024. However, it has not evoked any response.

6.The learned Government Advocate for the respondents 1 and 2, on the other hand, would submit that the procedure for issuance of legal heirship certificate has been altered and that an application has to be made through online and if such an application is filed through online, the same will be considered and disposed of on merits in accordance with the prevailing rules and the notification issued under the provisions of the Registration of Births and Deaths Act, 1969. 3/5

7.Recording the above submission, this Writ Petition stands disposed of, by directing the petitioner to file a fresh application through online. In case, such an online application is filed, the second respondent shall cause an enquiry through the Village Administrative Officer of the concerned village and proceed to issue the legal heirship certificate, as expeditiously as possible, preferably within a period of 3 months from the date of such enquiry. 8.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
