PRAYER :- For Bail in Crime No.114 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/2nd Accused, who was arrested on 29.05.2023 for the alleged offence under Sections 147, 148, 294(b), 336, 341, 342, 323, 302 and 506(ii) of IPC, in Crime No.114 of 2023 on the file of the respondent Police, seeks bail.
2.The prosecution case is that on 08.04.2023, the defacto complainant preferred a complaint stating that there was a temple festival conducted in his village, at that time, one Ranjith/A1 entered into wordy quarrel, thrown stones in to the crowd and he ran away. Injured person was admitted in hospital. Later, the above said Ranjith and his friends scolded the defacto complainant and his friends in filthy language, first accused stabbing one Vigneshwaran on the chest and right side shoulder with their hidden machetes, due to the injuries he died on the spot. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the 1/3
prosecution. He would further submit that the petitioner is in judicial custody from 29.05.2023 and the previous bail application that was filed by the petitioner was dismissed by the Principal District and Sessions Court, Pudukkottai, on 30.06.2023. 4.The learned Additional Public Prosecutor appearing for the respondent Police submitted that on 07.04.2023, the above said person was assaulted with some stones. Due to retaliation of the above said occurrence, the accused assaulted the deceased with knife and causing death in spot itself.
5.The learned counsel for the petitioner would further submit that the petitioner is also standing in the very same footing like accused Nos.3, 4 and 5, who are granted bail by the Principal District and Sessions Court, Pudukkottai, in Crl.M.P. No.1766 of 2023 dated 05.06.2023. Subsequent to the above said order, the seventh accused was detained under Act 14, even though he was granted regular bail.
6. The learned Additional Public Prosecutor would futher submit that A1 only stated to have caused assault the deceased with knife and other accused persons surrounded the deceased and hold him to cause assault.
7.Considering the fact and circumstances of this case and considering the period of incarceration and only the first accused assaulted the deceased with knife, this Court is inclined to grant bail to the petitioner with certain conditions; 8.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranur, and on further condition that the petitioner shall report before the respondent Police daily at 10.30 a.m. until further orders.
