BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 27.06.2025

CORAM

THE HON`BLE MR.JUSTICE B.PUGALENDHI Thavamani ... Petitioner versus The State of Tamil Nadu, rep. by The Inspector of Police, Virudhunagar West Police Station, Virudhunagar District.

... Respondent Prayer : Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the Judicial Magistrate Court No.I, Virudhunagar, Virudhunagar District to expedite the trial in C.C.No.17 of 2025 within a time frame.

For Petitioner : Mr.D.Rajaboopathy For Respondent : Mr.P.Kottaichamy, Government Advocate (Crl. Side)

ORDER

The petitioner is the defacto complainant in C.C.No.17 of 2025. She has moved this petition seeking a direction to the trial Court to conclude the trial in C.C.No.17 of 2025 within a stipulated time. 1/4

2. It appears that the final report itself has been taken on file by the trial Court only in the year 2025. However, the petitioner has filed this petition seeking a direction to the trial Court as if the trial Court has not acted upon the final report.

3. The reason assigned by the petitioner is that she is facing a threat from the accused person to withdraw the case which is pending on the file of the learned Judicial Magistrate No.I, Virudhunagar, in C.C.No. 17 of 2025. In the event, if the petitioner is facing a threat, it is always open to her to lodge a complaint before the concerned Police Station. On this ground, this Court is not inclined to entertain this petition. The Courts are also responsible to other litigants and other long pendency cases.

4. Therefore, this Criminal Original Petition is dismissed. 27.06.2025 Index : Yes / No.
