ORDER
The petitioner herein seeks a direction to the respondents 1 and 2 to issue a joint patta in the names of all the legal heirs of the petitioner's father, in respect of the properties situated in Survey Nos.233/10, 233/8B, 42/1B, 99/1, 99/2A, 99/3 and 99/8A1A in Pullur group, Thiruvadanai Taluka, Ramanathapuram District, by considering his representation dated 12.06.2025.
2.Heard the arguments of Mr.B.Mahendrarajan, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader appearing for the respondents 1 to 3. Since no adverse order is passed against the fourth respondent, notice to the fourth respondent is dispensed with.
3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4.According to the petitioner, the subject property was purchased by his father, Abdul Rasheed @ Abdul Azeed under a registered sale deed dated 19.07.1999. The patta for the subject property stands in the name of his father. After death of her father and mother, the patta was wrongly issued in the name of one of his brothers, namely, the fourth respondent, excluding the other legal heirs of the petitioner's father. The petitioner submitted a instant representation dated 12.06.2025 before the respondents 1 to 3 and the same has not been considered. Hence, he has come before this Court.
5.The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit the representation of the petitioner will be considered in accordance with law.
6. In view of the submissions made by the learned Additional Government Pleader appearing for the official respondents, this Court, without expressing any
opinion on the merits of the matter, is inclined to direct the third respondent to consider the representation of the petitioner dated 12.06.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner, fourth respondent and other legal heirs of petitioner's father Abdul Rasheed @ Abdul Azeed.
