Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first and second respondents to measure the petitioner's land in Survey No.T.S-58, New Survey Ward No.AE and Block No.18 situated at old Pandian Street, Kottaiyur, Ranjithapuram, Jamal Mohamed College, Trichy District based on the revenue records and with the petitioner's application dated 14.07.2021 within a stipulated time fixed by this Court. ORDER

The petitioner has filed a Writ Petition in the nature of Mandamus, seeking a direction against the first and second respondents to measure the land in survey No.T.S.-58, New Survey Ward No.AE and Block No.18 at Old Pandian Street, Kottaiyur, Ranjithapuram, Jamal Mohamed College, Trichy, on the basis of the representation, dated 14.07.2021.

W.P(MD)No.17836 of 2021 2.The aforesaid land had been purchased by the husband of the petitioner, Ayyan Chettiyar by a registered sale deed on 20.07.1967, registered as Document No.3345 of 1967 in the Office of the Sub Registrar, I and II, Trichy. There is no pleading in the Writ Petition that Patta had been granted to the petitioner herein even before conducting survey. If an order is also granted, the revenue official would naturally expect that the petitioner has patta in her name before conducting survey. Therefore, the petitioner should take a necessary steps to get Patta transfered in her name from the name of her husband and thereafter take necessary steps for conducting survey.

3.By granting that liberty, the Writ Petition is disposed of. No costs.
