PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 1st respondent to not to harass the petitioner and his family member unnecessarily against law under the guise of enquiry during the pendency of the civil suit and directing the 1st respondent to act in accordance with law.

ORDER

This Criminal Original Petition is filed seeking direction to the 1st respondent to not to harass the petitioner and his family member unnecessarily against law under the guise of enquiry during the pendency of the civil suit and directing the 1st respondent to act in accordance with law.

2.The learned counsel appearing for the petitioner would submit that the petitioner is a agreement holder and he has made an agreement with one Suresh. Before completion of agreement the said Suresh died. Since he had paid major portion of sale consideration he started construction and spent more amount. In the meanwhile, the legal heirs of the Suresh sold the property to the 2nd respondent. Now, the 2nd respondent has preferred a complaint against the petitioner and based on the said complaint, the police officials have harassed the petitioner. Hence, this petition.

3.The learned Government Advocate (crl. side) appearing for the 1st respondent would submit that based on the complaint given by the 2nd respondent a case has been registered against the petitioner in Crime No.301 of 2022, dated 05.08.2022 for the offences under Sections 294(b), 448, 420 and 506(i) of IPC. Now, the case is under investigation. The submission recorded.

4.Recording the aforesaid submission, the Criminal Original Petition stands closed.
