ORDER
Seeking to direct the 2nd and 3rd respondents to provide adequate police protection to fence the petitioner's property in Survey No.253/3B1 to an extent to 65 Cents situated at Sattur Village, Sattur, Virudhunagar District and to take necessary action on the petitioner's complaint dated 04.05.2026 as against the 4th and 5th respondents, this writ petition is filed.
2. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.
3. The learned counsel for the petitioner submitted that the petitioner is the absolute owner in possession and title with respect to the subject property. He has been enjoying the same without any interference for the past several years. While so, the respondents 4 and 5 started interfering with the peaceful possession and enjoyment of the subject property. Pursuant to which, O.S.No. 121 of 2012 was filed by the petitioner on the file of the learned District Munsif Court at Sattur, Virudhunagar District as against the respondents 4 and 5 and 2/5
the same was decreed in favour of the petitioner on 08.08.2025, against which no appeal has been preferred by the 4th and 5th respondents. However, the disturbance with respect to the enjoyment of the property subsist. Hence, this petition is filed to direct the respondent police to afford necessary police protection to fence the property.
4. The learned Government Advocate(Crl.side) submitted that the matter would be looked into.
5. Heard the learned counsel on either side and carefully perused the materials available on record.
6. In view of the above, the petitioner is directed to produce all necessary documents, including the decree in his favour to the 3rd respondent and on perusal of the same, the 3rd respondent police is also directed to put the petitioner as well as the 4th and 5th respondents on notice under Section 64 BNSS and after giving an opportunity of hearing to both the parties, conclude the enquiry within a period of four (4) weeks from the date of receipt of copy of this order, and thereafter extend necessary police protection to the petitioner on payment of the necessary charges in terms of G.O(Ms)No.139, Home (Pol-VIII) 3/5
