PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition No.(ii) imposed in Crl.MP.No.1126 of 2025 dated 09.06.2025 on the file of the learned Principal Sessions Judge, Theni. ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.(ii) imposed in Crl.MP.No.1126 of 2025 dated 09.06.2025 on the file of the learned Principal Sessions Judge, Theni.
2. The learned Counsel for the petitioners would submit that the petitioners have filed an anticipatory bail application before the learned Principal Sessions Judge, Theni in Crl.MP.No.1126 of 2025. The said bail petition was heard and on 09.06.2025, the Hon'ble trial Court was pleased to grant anticipatory bail to the petitioners with certain conditions. In the said bail order, Condition No.(ii) as follows:
''(ii). The petitioners shall appear and report before the Respondent Police Station daily at 10.00a.m for 30 days and thereafter, shall appear on summons. In the event that the petitioners fail to surrender within 15 days from the date of the order, the anticipatory bail granted will automatically lapse.'' 2/4
3. He further submits that the petitioners 1, 3 & 4 are women. The fourth petitioner is working as an Administrative staff at Mary Matha Arts and Science College, Peiryakulam. The second petitioner is the sole bread winner of his family. The third petitioner is having six months old child and the first petitioner is the house wife. The petitioners find it very difficult to comply the conditions daily before the respondent police. Therefore, the petitioners seek indulgence of this court by modifying the said condition imposed against them. Hence, he prays for modification of the said condition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.
5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition No.(ii) in the order made in Crl.MP.No.1126 of 2025 dated 09.06.2025 on the file of the learned Principal Sessions Judge, Theni. Accordingly, Condition No.(ii) is modified as ''(ii). The petitioners are ordered to appear and sign before the respondent police weekly twice i.e., on every Wednesday and Sunday at 10.00a.m. until further orders.'' . The other conditions shall remain unaltered. 3/4
