Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondent No.2 not to mutate the
revenue records pertaining to the property situated in S.No.1169 to the extent of 6.13 Acres out of 7.93 Acres situated at Kalvarpatti Village, Vedasandur Taluk, Dindigul District in favour of any third party pending disposal of the suit in O.S.No.109 of 2026 on the file of the Sub Court, Vedasandur.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondent No.2 not to mutate the revenue records pertaining to the property situated in S.No.1169 to the extent of 6.13 Acres out of 7.93 Acres situated at Kalvarpatti Village, Vedasandur Taluk, Dindigul District in favour of any third party pending disposal of the suit in O.S.No.109 of 2026 on the file of the Sub Court, Vedasandur.
2.The petitioner submitted that the present property in dispute situated in S.No.1169 to the extent of 6.13 Acres out of 7.93 Acres belongs to the petitioner based on the sale deed dated 23.09.1963 in Doc.No.2006 of 1963 on the file of the Sub Registrar Office,, Vedasandur, Dindigul District. However, the 6th respondent is disputing the same. A suit is being filed in O.S.No.109 of 2026 on the file of the Sub Court, Vedasandur, wherein the 6th respondent is impleaded as the 5th defendant in the suit. The suit is filed for declaration and injunction. Therefore, now the petitioner is seeking a direction not to mutate until the suit is disposed.
3.When there is a title dispute between the parties and the parties have approached the competent Court for declaration, then there cannot be any mutation of revenue records. Therefore, the official respondents are directed to consider the petitioner's application after issuing notice to the petitioner and the 6th respondent and pass appropriate orders in accordance to law within a period of three months from the date of receipt of a copy of this order. While considering the same, the official respondents shall take into the consideration of the observations made supra. 4.With the above observations, this Writ Petition is disposed of.
