ORDER
The petitioner herein seeks a direction to the respondents to consider his objection regarding land acquisition for proposed new ring road from Viraganur to Chakkudi and to consider change of alignment at Karuppapillaiyenthal Village, by considering his representations dated 30.05.2025 and 05.06.2025 within the time stipulated by this Court.
2.Heard the arguments of Mr.J.Senthil Kumaraiah, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the petitioner that he purchased the subject property in the year 2022 and he has been using the same for agriculture purpose. The petitioner also put up a residential house in the portion of the property. The respondent issued a notification under Section 15(2) of the Tamil Nadu Highways Act for acquisition of subject property for the proposed ring road. Aggrieved by the proposed alignment of the ring road, the petitioner submitted a representation before the respondents on 05.06.2025. The same has not been considered. Hence, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents would submit that a preliminary notification under Section 15(2) of the Tamil Nadu Highways Act has been issued. The objection
raised by the petitioner will be considered by the competent authority, namely, the Special District Revenue Officer (Land acquisition), Madurai, in accordance with law.
5.In view of the statement made by the learned Additional Government Pleader appearing for the respondents, without expressing any opinion on the merits of the objection raised by the petitioner, the competent authority is directed to consider the objection raised by the petitioner and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order and proceed further in accordance with law thereafter. Accordingly, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 30.06.2025 NCC : Yes/No Index : Yes/No Internet : Yes/No cp
