RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to stay all further proceedings of the case in C.C.No.142 of 2020 on the file of the Fast Track Court (Magisterial Level) Karaikudi, Sivagangai District, till the disposal of the main Criminal Revision petition.

Prayer in CRL RC(MD). 675/ 2020 :

To call for the records pertaining to the impugned order dated 30.09.2020 in Cr.M.P.No.50 of 2020 in C.C.No.142 of 2020 on the file of the Fast Track Court(Magisterial Level), Karaikudi, Sivagangai District and to set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.S.MAHENDRAPATHY, Advocate for the petitioner, while admitting the Criminal Revision Case, the Court made the following order:- This petition has been filed to stay all the further proceedings in C.C.No.142 of 2020 on the file of the Fast Track Court (Magistrate Level) Karaikudi, Sivagangai District, till the disposal of the main criminal revision petition. 2.On the side of the petitioner, it is stated that the petitioner is ready to deposit 20% of the cheque amount and prayed to grant interim stay of the proceedings.

CRL MP(MD) No.6762 of 2020 petitioner, this Court is inclined to grant interim stay till the disposal of the criminal revision case on condition that the petitioner has to deposit a sum of Rs.37,500/- (Rupees Thirty Seven Thousand and Five Hundred only) to the credit of in C.C.No.142 of 2020 on the file of the Fast Track Court (Magistrate Level) Karaikudi, Sivagangai District, on or before 18.12.2020. On such deposit, the Fast Track Court (Magistrate Level) Karaikudi, Sivagangai District,, shall re-deposit the sum of Rs.37,500/- (Rupees Thirty Seven Thousand and Five Hundred only) in any Nationalised Bank, so that, the amount accrues interest and the same can be disbursed depending upon the outcome of the present Criminal Revision Case. Failing which, the interim stay already granted stands automatically vacated.
