Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to include the petitioner's name in the State wide Seniority List on par with other Plot Watchers so as to enable him to get his services regularization in the post of Plot Watcher in the light of G.O.Ms.202, Environment and Forest Department dated 18.12.2013, by considering the report of the third respondent Na.Ka.3647/2019/A3 dated 13.12.2021.

ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The petitioner herein seeks for regularization of his services in the post of Plot Watcher in the light of G.O.Ms.No.202 Environment and Forest Department, dated 18.12.2013. In this connection, when the petitioner had 2/5

earlier filed a Writ Petition before this Court in W.P.(MD).No.8302 of 2018 seeking for regularization, this Court, by its order, dated 17.04.2018, had directed the respondents to consider his request within a stipulated time. Pursuant to such directions, the third respondent herein had also made favourable recommendation to the second respondent in Na.Ka.No.3647/2019/A3, dated 13.12.2021, which is said to be pending. The petitioner herein has also made another representation to the second respondent on 06.06.2022, seeking for regularization, which is also pending.

In the light of these developments, there shall be a direction to the second respondent to consider the petitioner's representation, dated 06.06.2022, in the light of the recommendation of the third respondent herein in Na.Ka.No.3647/2019/A3, dated 13.12.2021, on its own merits and pass appropriate orders in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. Since the earlier order of this Court has not been complied with till date and it is still under consideration, the respondents shall not disturb the employment of the petitioner herein till the disposal of the representations.

4. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
