Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents 1 to 4 to provide the compensation amount for the land in Survey No. 140/1 situated

at Annaikaraipatti acquired for the Irukankudi water reservoir, based on the petitioner's representation, dated 02.07.2024. For Petitioner :

ORDER

The petitioner herein seeks a direction to respondents 1 to 4 to provide compensation for the land situated in Survey No.140/1 at Annaikaraipatti, acquired for Irukankudi Water Reservoir, by considering her representation, dated 02.07.2024.

2. According to the petitioner, the subject property was allotted to her father in an oral partition in the family and the same was acquired by the Government for Irukankudi Water Reservoir project in the year 2000, but compensation amount has not been paid till-date. Therefore, she submitted a representation before the respondents, seeking payment of compensation. The same has not been considered. Hence, she has come before this Court.

3. Government Advocate, appearing for the respondents, by drawing attention of this Court to the counter affidavit filed by the third respondent, would submit that in view of the dispute among the legal heirs of the original owner Subbiah, compensation amount was deposited on the file of

Sub-Court, Sivakasi, in L.A.O.P.No.22 of 2000, under Section 30 of the Land Acquisition Act,1894.

4. In view of the fact that compensation amount is already deposited before the civil court, it is for the petitioner to work out her remedy, by approaching the court concerned.

5. With the above clarification, the Writ Petition stands disposed of. No costs.
