ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 of I.P.C r/w 21(4) Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.157 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner has illegally transported 1/2 unit of sand by using TATA 407 vehicle. Therefore, the present case came to be registered.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) for the respondent police submitted that earlier anticipatory bail https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.14497 of 2022 application that was filed by the petitioner came to be dismissed on the ground that he is having previous case and this is the third anticipatory bail application, which has been filed without any change of circumstance.
5.The learned counsel for the petitioner would submit that the petitioner is the owner of vehicle and he is ready to deposit the amount imposed by this Court.
6.But, considering the antecedent of the petitioner and also considering the fact that there is no change of circumstance, this Criminal Original Petition is dismissed.
