Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the first and second respondents to survey the petitioner's land in S.F.No.205/F2 measuring about 0.03.5 ares in Mookkudi Village, Aranthangi Taluk, Pudukkottai District with the help of police officials by considering the petitioner's representation, dated 26.09.2016.

O R D E R

The petitioner seeks for a Mandamus directing the first and second respondents to survey the land at S.F.No.205/F2 measuring an extent of 0.03.5 ares in Mookkudi Village, Aranthangi Taluk, Pudukkottai District, by considering his representation, dated 26.09.2016.

Even though the private parties are also arrayed as party respondents 3 to 8 in this writ petition, in view of the limited scope involved in the present case, this court is of the view that this writ petition can be disposed of, without issuing notice to the private respondents and also not by affecting their interest in any manner.

3. Mr.A.Muthu Karuppan, the learned Additional Government Pleader takes notice for the respondents 1 and 2.

4. The petitioner seeks for survey of the above said land, it appears from the affidavit filed in support of the writ petition that the private respondents are claiming some right over the said land, which according to the petitioner, is not sustainable. This court, at this stage, is not inclined to express any view on the claim made by the petitioner as she has already made a representation to the respondents on 26.09.2016, seeking for survey. Thus, the second respondent shall consider the representation of the petitioner and hear the petitioner as well as the private party respondents and pass orders on the representation of the petitioner on merits and in accordance with law, within a period of twelve weeks from the date of receipt of the copy of this order.

5. With the above direction the writ petition stands disposed of. No costs.
