The petitioner filed the present Writ Petition seeking issuance of a Writ of Mandamus to direct the first respondent to issue patta in the name of the petitioner, considering the petitioner's application dated 02.05.2022.
2.Heard the learned Counsel for the petitioner and Mrs.S.Jeyapriya, learned Government Advocate appearing for the respondents.
3.The grievance of the petitioner is that in respect of the petitioner's land, patta has been wrongly mutated in the name of the fourth respondent and therefore, the petitioner has immediately sought for rectification of the said wrong entry by making a representation to the respondents as early as on 29.11.2019. The first respondent on receipt of the said application from the petitioner in and by proceedings in Na.Ka.No.11/2020/Aa1 dated 28.01.2020 2/5
directed the second respondent Tahsildar to conduct an enquiry and forward a detailed report. The grievance of the petitioner is that despite such a positive direction issued by the first respondent, the second respondent is sitting over the file without any progress being made.
4.Considering that the petitioner's application has been pending for almost five years, this Writ Petition is allowed, with a direction to the second respondent to conduct an enquiry and forward his findings to the first respondent within a period of four [4] weeks from the date of receipt of a copy of the order and on receipt of such report from the second respondent, the first respondent shall take a final call for issuance of patta within a period of four [4] weeks thereafter.
