S.Santhanakrishnan, v. The Secretary To Govt.,
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 08.12.2016 CORAM :
THE HONOURABLE MR.JUSTICE K.RAVICHANDRABAABU W.P(MD)No.23804 of 2016 S.Santhanakrishnan ... Petitioner Vs.
1.The Secretary to Government, Higher Education Department, Fort St. George, Chennai - 600 009.
2.The Director of Collegiate Education, College Road, Nungambakkam, Chennai - 600 006.
3.The Joint Director of Collegiate Education, Madurai Region, Balam Station Road, Sellur, Madurai - 2.
... Respondents Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the respondents herein to appoint the petitioner herein as special officer for effective administration of Yadava College (Coeducation), Thiruppalai, Madurai, by considering the representation of the petitioner herein dated 11.11.2016. For Petitioner : Mr.V.B.Sundhareshwar For Respondents : Mr.B.Pugalendhi Additional Advocate General assisted by Mr.A.Muthukaruppan Additional Government Pleader
O R D E R
Mr.B.Pugalendhi, learned Additional Advocate General takes notice for the respondents. By consent, this writ petition is taken up for final disposal.
2.The petitioner seeking for a direction to the respondents to appoint him as Special Officer for effective administration of Yadava College (Co-education), Thiruppalai, Madurai, by considering his representation dated 11.11.2016. https://hcservices.ecourts.gov.in/hcservices/ 3.It is seen that as against the existing committee, proceedings are initiated by issuing show-cause notice to the
Office-bearers of the Committee. No doubt, it is stated that several writ petitions are pending touching upon the said proceedings initiated by the Government. However, the petitioner is not a committee member and only life member of the General body of Yadhava Community College, namely, Yadhava College at Thiruppalai and he made a representation on 11.11.2016 to consider him for the post of Special Officer.
4.I do not think that the petitioner can seek himself to be appointed as Special Officer, either as a matter of right or as a matter of routine. It is for the Government to appoint such Special Officer by following procedures contemplated under the relevant enactment. When such being the position, the petitioner cannot file the present writ petition for issuing a direction to the respondents to consider the said representation. Needless to say that it is for the Government to appoint as suitable person as a Special Officer for effective administration as and when an occasion arises. Therefore I find that the writ petition is totally misconceived.
5.Accordingly, the writ petition fails and the same dismissed. No costs.
