ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 8(c) r/w.20(b), (ii), (B), 29(1) and 25 of NDPS Act, 1989, in Crime No.247 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 27.05.2023, the first accused found in illegal possession of 4 Kg of Ganja and Rs.1,11,000/-. Based on the confession statement of the first accused, this petitioner and the third accused have been implicated in this case. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and only on the confession statement of the first accused, he has been implicated in this case. Absolutely, the petitioner is not involved in the above said cae and no other material has been recovered from this petitioner.

4. The learned Additional Public Prosecutor would submit that the custodial interrogation is required.

5.Considering the submission made by the learned Additional Public Prosecutor and considering the serious allegation made against the petitioner, this petitioner is not entitled for any discretionary relief.
