Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 14.09.2021 to conduct election to the Jamath namely Masjid Noor Jumma Jamath situated at North Ammapattinam, Manamelukudi Taluk, Pudukottai District in accordance with the procedure enumerated under Wakf Act.

ORDER

The petitioner seeks a direction for the conduct of elections to the Masjid Noor Jumma Jamath at North Ammapattinam, Manamelukudi Taluk, Pudukottai District.

2.The petitioner states that he is a member of the above mentioned Jamath. In fact, it is contended that he was selected as the President of the Administrative Committee on 11.08.2021. The petitioner states that there is a conflict with one Hithayathullah. In order to ensure that such conflicts are resolved and the Jamath carries on its activities smoothly, the petitioner submitted a representation on 14.09.2021 to respondents 1 to 3 to conduct elections to the Jamath. The present writ petition is filed in that connection.

3.Mr.D.S.Haroon Rasheed, learned Standing Counsel, accepts notice for all the respondents. He submits that the second respondent may be directed to consider and dispose of the representation within a reasonable time frame. 4.Given the limited scope of the present writ petition, it is not necessary to enter findings on the merits thereof. Instead, it would be sufficient if the second respondent is directed to dispose of the representation expeditiously.

5.Accordingly, the second respondent is directed to consider and dispose of the petitioner's representation dated 14.09.2021 by a reasoned order within a period of three (3) months from the date of receipt of a copy of this order.

6.W.P.(MD).No.17592 of 2021 is disposed of on these terms without any order as to costs.
