ORDER : The Court made the following order :- The petitioner/ accused, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 147, 148, 294(b), 324 and 506(ii) of IPC r/w. section 25(1A) of Arms Act, 1959 in Crime No.152 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution as per the de-facto complainant is that during temple festival, the petitioner herein abused and assaulted the defacto complainant and also threatened with dire consequences, hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is ready to comply any stringent condition that may be imposed by the Court.

4. The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that the earlier anticipatory bail application that was filed by the petitioner in Crl.O.P(MD).Nos.9488 of 2023, was dismissed by this Court, on the ground that the petitioner is a habitual offender. Without any change of circumstances, the present petition has been filed. 2/3

5. Considering the fact that there is no change of circumstances and also considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
