O R D E R

The challenge made in this Writ Petition is against a notice issued to the petitioner to appear for an enquiry in respect of patta proceedings.

2. The enquiry was scheduled on 24.11.2016. Even according to the learned counsel appearing for the petitioner, enquiry was conducted on the said day and the petitioner has also filed his objection.

3. When that being the factual position, I do not think that this Writ Petition is maintainable as against the issuance of notice, more particularly, when the petitioner has also https://hcservices.ecourts.gov.in/hcservices/

participated in the enquiry and given his objections. Therefore, the Authority, namely, the first respondent will have to consider the respective claims of the parties and pass appropriate orders, on merits and in accordance with law. At this stage, with the present relief sought for in this Writ Petition, this Court cannot express any view on the claim made by the petitioner.

4. Accordingly, this Writ Petition is dismissed as infructuous. No Costs. Consequently, connected Miscellaneous Petition is closed.
