O R D E R
This petition has been filed, seeking to direct the respondents herein to pay the usual increments and differences in payment of the petitioner's salary from the date on which the petitioner was reinstated into service and also promotion on the basis of the petitioner's representation dated 20.10.2016.
2. The case of the Petitioner is that based on some flimsy charges, she was removed from service, against which she preferred an appeal before the 2nd respondent, who also confirmed her removal of service; that the petitioner challenged the order of the 2nd respondent before the Hon'ble Administrative Tribunal in O.A.No.9007 of 2000 in which interim stay of the order was granted in her favour, pursuant to which, she was reinstated into service; that she has been continuously working under the 3rd respondent for the past fifteen years without any promotion and other statutory benefits; that she sent a detailed representation to the respondents on 20.10.2016 for taking immediate action for giving promotion and other benefits to her and since her request has gone into the deaf ear, she is before this Court, seeking the above relief.
3. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents.
4. Admittedly, the petitioner has got the benefit of interim order granted by the Hon'ble Administrative Tribunal, on account of which, she has been working in the department, but without any promotion and other benefits and she has also given a representation dated 20.10.2016, requesting the respondents to grant promotion, time increments etc.
5. Once a representation has been received by the respondents, it is their bounden duty to decide the same in one way or the other. Therefore, the 4th respondent is directed to consider the representation of the petitioner dated 20.10.2016 and pass appropriate orders thereon on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order, preferably on or before 28.02.2017.
