ORDER

Mr.G.Vishnuram, learned Central Government Standing Counsel takes notice for the first respondent and Mr.K.Sanjai Gandhi, learned Government Advocate (Crl.side) takes notice for the second respondent. 2.The writ petition has been filed for a Writ of Mandamus, directing the first respondent not to impound the petitioner's passport bearing passport No.AA837794 in connection with the show cause notice issued in File No. TR2074997662025 dated 21.05.2025, in light of the representation dated 30.05.2025.

3.It is confirmed by the learned Government Advocate (Crl.side) for the second respondent that although the petitioner has been arrayed as second accused person in the FIR registered in Crime No.327 of 2018, dated 10.12.2018, for the offences under Sections 332, 109, 506(2) IPC and Section 21(1) of Mines 2/5

and Minerals (Development and Regulation) Act 1957, no charge sheet has been filed against the petitioner so far.

4.It is noticed that the petitioner was in possession of the passport and had applied for renewal of the same and it was also renewed and despatched on 06.05.2025. However, after the passport was renewed and sent to the petitioner, the respondents have issued a notice on 21.05.2025 stating that why the passport should not be impounded, in view of the registration of the FIR in Crime No.327 of 2018.

5.Since no charge sheet has been filed barring registration of the FIR against the petitioner for the offences mentioned above, impounding of the passport cannot be countenanced. However, it is made clear that the petitioner shall report to the second respondent, in case, the petitioner proposes to travel abroad.

6.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
