ORDER
This petition is filed seeking for a direction to the respondent police to grant permission for performing Adal Padal programme on 10.07.2023 from 06.00 pm to 11.00 pm at Sri Mariamman Temple Festival, Cholarajapuram village, Woraiyur Post, Tiruchirappalli Taluk, Tiruchirappalli District. However, the respondent police have rejected the request of the petitioner as per the proceedings dated 27.06.2023.
2.It is submitted by the learned counsel for the petitioner that in an earlier occasion, on account of some misunderstanding, a small incident has taken place. Based on the said incident, the police have declined to grant the permission. 3.On the other hand, the learned Government Advocate (Crl.side) submits that after submitting a representation to the respondent police, there were altercation between two groups in respect of conducting of the programme on 10.07.2023 from 06.00 pm., to 11.00 pm., at Sri Mariamman Temple and on 2/5
account of that, on receipt of the complaint, the police have registered two First Information Reports, of which one First Information Report is registered against the petitioner herein.
4.Considering the circumstances, if the festival is allowed to be performed, on account of the pendency of two criminal cases and since the two groups are divided vertically, as rightly apprehended by the prosecution, there is every possibility that the law and order in the village may likely to disturb. The festivals are required to create harmony in the village amongst all the groups. If the festival of this kind is allowed to be performed, it will create tension and law and order problem in the society. Therefore, the respondents are rightly rejected the request of the petitioner.
5.With the above observation, this Writ Petition is dismissed. However, there shall be no order as to costs.
