For R1 to R3 : Mr.M.Sakthi Kumar Government Advocate (Crl. side)

ORDER

The petitioner has approached this Court that the respondent Police is interfering in a civil dispute and harassing him under the guise of enquiry.

2. The learned Government Advocate (Crl. Side) submits that the 4th respondent has lodged a complaint before the first respondent/the Superintendent of Police, Karur District, who forwarded the same to the 3rd respondent Police for enquiry. The 3rd respondent is conducting enquiry in current paper No. 326/Pet/SP/SDGP/camp/krr/2024 and the same is pending.

3. The learned Government Advocate (Crl. Side) submits that 4th respondent has borrowed money from the petitioner. The petitioner, a money lender, has insisted the 4th respondent to execute a power of attorney for the loan amount which he has advanced to 2/5

the 4th respondent. However, the petitioner, taking advantage of the power attorney, has created a document on the 4th respondent's property.

4. It appears that a clear case is made out in this case. The respondent Police is not supposed to keep the petition enquiry for more than four weeks. The petitioner is directed to appear before the 3rd respondent Police for a period of one week and co-operate for the enquiry. The respondent Police is directed to conclude the enquiry and register a criminal case, if any cognizable offence is made out.
