For Respondent : Ms.Anantha Devi, Government Advocate (Crl.Side) Petition for modification under Section 439(1)(b) of Cr.P.C PRAYER :- Criminal Original Petition filed under Section 439(1)(b) of Criminal Procedure Code to modify the condition imposed on the petitioner in Crl.M.P.No.1763 of 2019 dated 23.07.2019 to the effect that the petitioner shall comply any other sureties as ordered by this Honble court instead of the The petitioner would be released on bail with 2 sureties and directed to deposit a sum of Rs.2,00,000/- (Two lakhs only) by cash within 15 days from the date of enlarged on bail in Judicial Magistrate No.II, Dindigul to the credit in Cr.No.15/2019 of Dindigul DCB P.S., if the petitioner not deposited the cash security amount of Rs.2 Lakhs within 15 days, the prosecution can be moved for cancellation of bail. https://hcservices.ecourts.gov.in/hcservices/

ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed by the learned Principal Sessions Judge, Dindigul in Crl.M.P.No.1763 of 2019 dated 23.07.2019.

2. In the order passed by the learned Principal Sessions Judge, Dindigul in Crl.M.P.No.1763 of 2019 dated 23.07.2019, it is stated that the learned counsel for the petitioner gave an undertaking that the petitioner will pay a sum of Rs.2,00,000/- after the petitioner is enlarged on bail. Considering the same, the learned Principal Sessions Judge, Dindigul has granted bail to the petitioner.

3. Now the learned counsel for the petitioner submitted that the petitioner has availed the said order and executed a bail bond and the petitioner came out from jail, but he is not able to pay such a huge amount. Hence the petitioner is directed to approach the same Sessions Court.

4. This petition is disposed of with liberty to the petitioner to approach the Sessions Court for getting appropriate relief.
